SUBSTITUTE TRUSTEE'S NOTICE OF SALE WHEREAS, on the December 11, 2017, Richard Holmes, executed a Deed of Trust to First American Title Insurance Company, Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Research Center, LLC dba Veterans United Home Loans, its successors and assigns, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Oktibbeha County, Mississippi, in Deed of Trust December 11, 2017, in Book No. 2017, at Page 23076 thereof; WHEREAS, said Deed of Trust was ultimately assigned to Mortgage Research Center, LLC d/b/a Veterans United Home Loans, a Missouri Limited Liability Company by assignment on file and of record in the office of the Chancery Clerk of Oktibbeha County, Mississippi, in March 22, 2019, in Book No. 2019, at Page 4549 thereof; and WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted Wilson & Associates, PLLC, as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in June 6, 2019, in Book No. 2019, at Page 10047 thereof; and WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that Wilson & Associates, PLLC f/k/a Adams & Edens, P.A., Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee, during the legal hours (between the hours of 11 o'clock a.m. and 4 o'clock p.m.) at the front door of the Courthouse, on August 14, 2019, the following described land and property being the same land and property described in said Deed of Trust, situated in Oktibbeha County, State of Mississippi, to-wit: Commencing at the concrete monument found at the Northeast corner of Section 14, Township 18 North, Range 13 East, Oktibbeha County, Mississippi; thence South 48 degrees 18 minutes 31 seconds West for a distance of 1,768.54 feet to a half inch iron rebar found on the South right of way of Old Highway 12; thence continue along said right of way along a non-tangent curve to the right having a radius of 8687.29 feet, a chord bearing of South 65 degrees 49 minutes 38 seconds West, a chord distance of 394.82 feet and an arc length of 394.85 feet to a half inch iron rebar found; thence South 00 degrees 04 minutes 11 seconds West for a distance of 1516.19 feet to a half inch rebar set on the West right of way of West Union Road, said rebar being also the true Point of Beginning for the herein described tract; thence continue along said right of way South 00 degrees 04 minutes 11 seconds West for a distance of 290.40 feet to a half inch rebar set; thence North 89 degrees 55 minutes 46 seconds West for a distance of 300.00 feet to a half inch rebar set; thence North 00 degrees 04 minutes 14 seconds East for a distance of 290.40 feet to a half inch rebar set; thence South 89 degrees 55 minutes 46 seconds East for a distance of 300.00 feet to a point to the true Point of Beginning and containing 87,120 square feet or 2.00 acres, more or less, being subject to all codes, regulations and restrictions, casements, and rights of way of record. Plus a permanent and perpetual non-exclusive easement for ingress and egress along a private road called West Union Road as follows: Commencing at the concrete monument found at the Northeast comer of Section 14, Township 18 North, Range 13 East, Oktibbeha County, Mississippi; thence South 48 degrees 18 minutes 31 seconds West for a distance of 1,768.54 feet to a half inch rebar found on the south right of way of Old Highway 12; thence along said right of way along a non-tangent curve to the right having a radius of 9,003.74 feet, a chord bearing of South 65 degrees 37 minutes 16 seconds West, a chord distance of 329.55 feet and an arc length of 329.57 feet to a to a half inch rebar set, said rebar being also the Point of Beginning; thence south 00 degrees 04 minutes 14 seconds West for a distance of 2,809.72 feet to a point on the South line of the CC Construction Property; thence along said South line North 89 degrees 55 minutes 46 seconds West for a distance of 60.00 feet to a point; thence North 00 degrees 04 minutes 14 seconds East for a distance of 2,784.00 feet to a Half inch rebar found on the South line of Old Highway 12; thence along said right of way North 66 degrees 54 minutes 02 seconds East for a distance of 39.63 feet to a point; thence continue along said right of way along a non-tangent curve to the right having a radius of 27,610.73 feet, a chord bearing of North 66 degrees 48 minutes 52 seconds East, a chord distance of 25.65 feel and an arc length of 25.65 feet to the true Point of Beginning. Plus an extension of the permanent and perpetual non-exclusive easement for ingress and egress along the existing private road called "est Union Road"described as follows: Commencing at the concrete monument found at the Northeast corner of Section 14, Township 18 North, Range 13 East, Oktibbeha County, Mississippi; thence South 48 degrees 18 minutes 31 seconds West for a distance of 1,768.54 feet to a half inch iron rebar found on the South right of way of Old Highway 12; thence continue along said right of way along a non-tangent curve to the right having a radius of 8687.29 feet, a chord bearing of South 65 degrees 49 minutes 38 seconds West, a chord distance of 394.82 feet and an arc length of 394.85 feet to a half inch iron rebar found; thence South 00 degrees 04 minutes 14 seconds West for a distance of 2784.00 feet to a half inch rebar found on the West right of way of West Union Road, said rebar being also the true Point of Beginning for the herein described tract; thence continue South 00 degrees 04 minutes 14 seconds West for a distance of 580.80 feet to a half inch rebar found; thence South 89 degrees 55 minutes 46 seconds East for a distance of 60.00 feet to a half inch rebar found; thence North 00 degrees 04 minutes 14 seconds East for a distance of 580.80 feet to a half inch rebar found; thence North 89 degrees 55 minutes 46 seconds West for a distance of 60.00 feet to a point to the true Point of Beginning and containing 34,848 square feet or 0.80 acres, more or less, being subject to all codes, regulations and restrictions, easements, and rights of way of record. Title to the above described property is believed to be good, but I will convey only such title as is vested in the aforementioned Substitute Trustee.
